These Terms and Conditions ("Terms") govern your use of the Stadio Mondo mobile and web application and associated services ("Platform"), operated by x-Sentience Ltd, registered in England and Wales (Company No. 13009829) with our registered office at 184 Cambridge Science Park, Milton Road, Cambridge CB4 0GA ("we", "us", or "our").
By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
By agreeing to these Terms, you acknowledge that you have read and understood how we collect, use, and share your personal data as described in our Privacy Policy.
1.1. Account Holders: You must be at least 16 years old to create and manage an account on the Platform for yourself.
1.2. Profiles for Players Under 16: Profiles may be created for players who are under the age of 16. However, such profiles may only be created and managed by a person who is 18 years old or over and who has the legal authority to act on behalf of that minor (such as a parent, legal guardian, or an authorised and verified club representative/manager).
1.3. Warranty: By creating an account, you represent and warrant that:
1.4. Protection of Minors (UK Children's Code): We are committed to protecting our users. As a UK-based company, we adhere to the principles of the UK's Age Appropriate Design Code (Children's Code). We provide specific data protections for all users under the age of 18, which are detailed in our Privacy Policy.
The Platform is designed to allow academy footballers ("Players") to upload and share their performance data (including match statistics, videos, and physiological metrics) ("User Content"). This content is organised to function as a professional networking and talent discovery system for verified football clubs, scouts, and other recognised organisations ("Clubs") to identify and evaluate talent globally.
3.1. You must provide accurate, complete, and up-to-date information during registration and in your profile.
3.2. You are responsible for safeguarding your account login credentials. You agree not to disclose your password to any third party and are solely responsible for any and all activities or actions that occur under your account.
3.3. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
4.1. Ownership: You (or the minor player you represent) retain all ownership rights to the User Content you upload, post, or display on the Platform.
4.2. Licence You Grant to Us: By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable licence to use, host, process, analyse, display, and distribute such content. This licence is for the limited purposes of operating, promoting, and improving the Platform, and making your content visible to other users (including Clubs) in accordance with your privacy settings.
4.3. Your Responsibility for Content: You warrant that you have all necessary rights, licences, and permissions to upload your User Content and that your content does not infringe on any third-party rights (including copyright, trademark, or privacy rights) or breach any applicable laws.
5.1. UK GDPR: We process all personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. All data processing activities are detailed in our Privacy Policy.
5.2. Personally Identifiable Information (PII): Your PII (such as your full name, contact details, or clearly identifiable images/videos) will not be made public or shared with Clubs without your explicit consent, which will be managed through your profile's privacy settings.
5.3. Anonymous and Performance Data: You acknowledge and agree that a core function of the Platform is the sharing of anonymous, aggregated, or de-identified performance data (e.g., speed, accuracy, match statistics, general location (city/region), age bracket) with Clubs for talent evaluation purposes. This non-personally identifiable data may be displayed or shared with Clubs and scouts to allow them to discover talent.
6.1. Service Advertising: The Platform is an advertising-supported service. As part of using the Platform, you will see advertisements from us or third-party partners.
6.2. Personalised Advertising: We will only provide you with personalised advertisements (i.e., ads tailored to your interests and activity) where we have your specific, affirmative, and freely-given consent. This consent is managed separately from these Terms (e.g., during sign-up or in your account settings).
6.3. Managing Consent: You are not required to consent to personalised advertising to use the core features of the Platform. You may manage your advertising preferences and withdraw your consent at any time via your account settings.
7.1. Verified Clubs may view anonymised data sets and search for Players based on performance metrics.
7.2. Where a user (or the parent/guardian of a user) has provided explicit consent via their privacy settings, personal profiles or contact details may be shared with or made discoverable to specific Clubs for recruitment or engagement purposes.

All rights, title, and interest in and to the Platform (excluding User Content) including its design, code, graphics, trademarks, and "look and feel," are and will remain the exclusive property of x-Sentience Ltd and its licensors, protected by UK and international intellectual property laws.
10.1. Termination by You: You may delete your account and terminate this agreement at any time via your profile settings.
10.2. Termination by Us (for Breach): We may suspend or terminate your access to the Platform immediately and without prior notice if you breach these Terms or use the Platform in a manner that we reasonably believe is unlawful or could cause us legal liability.
10.3. Termination by Us (for Convenience): We may also terminate or suspend your account for any other reason by providing you with at least 30 days' written notice.
10.4. Effect of Termination: Upon termination, your right to use the Platform will cease. All data will be handled in accordance with the retention and deletion schedules outlined in our Privacy Policy.
11.1. "As Is" Basis: The Platform is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free, nor do we make any guarantees regarding recruitment outcomes or engagement from Clubs.
11.2. Limitation of Liability: To the maximum extent permitted by law, x-Sentience Ltd (including its directors, employees, and agents) shall not be liable for any indirect, consequential, incidental, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the Platform; or (b) any conduct or content of any third party on the Platform.
11.3. Non-Excludable Liability: Nothing in these Terms shall limit or exclude our liability for:
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you (e.g., via an in-app notification or by email) to provide you with an opportunity to review the revised Terms. Your continued use of the Platform after such notice constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
